Terms of Service (EULA)

1. Introduction and Parties

These Terms of Service ("Terms") constitute a legal agreement between you ("User") and Hamza Faruk Gelisgen operating as Faro Apps ("Developer", "we", "us") regarding your use of the Focus Bud mobile application.

By downloading or using the app, you acknowledge that this agreement is concluded between you and the Developer only, and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for the Focus Bud app and the content thereof.

2. Scope of License

The Developer grants you a non-transferable, non-exclusive license to use Focus Bud on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. Subscriptions and Payments

Focus Bud offers premium features via auto-renewing subscriptions ("Pro").

• Billing: Payment will be charged to your Apple ID account at confirmation of purchase.
• Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
• Cancellation: You can manage and cancel your subscriptions by going to your App Store Account Settings after purchase.
• Refunds: All billing and refund requests are handled directly by Apple. The Developer does not have the ability to process refunds.

4. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services for Focus Bud. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.

5. Data and Privacy

Your use of Focus Bud is subject to our Privacy Policy. You acknowledge that Focus Bud stores data locally on your device. It is your responsibility to back up your device. The Developer is not responsible for data loss resulting from lost devices, deleted apps, or corrupted local files.

6. Limitation of Liability

For users in Germany: We are liable without limitation for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit). For slight negligence, we are only liable for the breach of essential contractual obligations (cardinal duties), limited to foreseeable damages. Liability for injury to life, body, or health remains unaffected.

For users outside Germany: To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, or consequential damages resulting from your use or inability to use the Service.

7. Product Claims

The Developer, not Apple, is responsible for addressing any claims relating to Focus Bud or your possession/use of the app, including: (i) product liability claims; (ii) claims that the app fails to conform to any applicable legal requirement; and (iii) claims arising under consumer protection legislation.

8. Third Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

9. Changes to Terms

We reserve the right to modify these Terms. If a revision is material, we will provide at least 30 days' notice. Continued use of the Service implies acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
